Say It With Sugar may at any time, at its sole discretion, amend or modify these Terms and Conditions without warning, and by continuing to use and/or make purchases through the website, you accept any modifications /amendments.
ACCEPTANCE OF TERMS AND CONDITIONS
By using this website and/or making a purchase through the online shop, you agree that you have read, understood and agree to abide by the Terms and Conditions of Say It With Sugar. If you do not agree with the Terms and Conditions, you must cease use of the website or any services immediately.
In order to purchase any products through the websites online shop, you must first register your membership. This service is free to access, and you may be required to provide personal information including:
- Full name
- Phone number
- Email address
- Postal address
You agree that this personal information is up-to-date and correct at all times. You also agree that you, the user, are over the age of 18, or have the permission from a legal parent/guardian to make purchases. This personal information is only used to complete your order and will not be used for any other purpose.
You agree that you are responsible for protecting the confidentiality of your password used to access your account, and use by anyone other than the registered person is prohibited. It is also your responsibility to notify Say It With Sugar immediately, if there is any unauthorised use of your password/account of which you have become aware. We do not take any responsibility for access/purchases to your account by anyone who you have given these confidential details to.
The products and services on the Say It With Sugar website are only available to those residing in Australia. Say It With Sugar reserves the right to terminate any membership accounts, remove content or cancel orders at any time if we deem the user is not following these Terms and Conditions.
Prices of items and delivery charges displayed on the Say It With Sugar website are current at the time of display. These prices are subject to change without notice. All prices are shown in Australian Dollars $AUD. Say It With Sugar reserves the right to set a maximum limit on a quantity of items you can order.
We have taken the time and used great care when entering information about products in to the system, however can not guarantee that there will not be any errors. If we have noticed an error in the price of any items you have purchased, you will be informed as soon as possible and we will give you the option of reconfirming the order or cancelling the order. GST (Goods and Services Tax)
All prices are inclusive of any/all taxes applicable to the product - currently Say It With Sugar is not registered for GST as we are a small business and can pass on these savings to you, the customer.
Say It With Sugar accepts payments through our secure online gateway on the online shop using Stripe or PayPal. We do not store any credit card details in our database.
We also accept Bank Transfer but please note that your order will not be processed or shipped until after the funds have cleared into our account.
SHIPPING & HANDLING
All orders are shipped Australia Wide via Auspost, Sendle or through a courier service at our discretion. Maximum weight for all orders is 22KG. If your order is over the maximum weight, we will contact you with shipping options.
You agree that all delivery information is correct including the address nominated - if you have entered the wrong address, Say It With Sugar will not be held responsible for the loss of product or postage costs. Anyone who receives the goods at the supplied address will be assumed to have authorisation by you.
REFUNDS & EXCHANGES
We do not offer refunds/exchanges for a change of mind. If your item is faulty, wrongly described, or we have sent you the wrong item, please email us directly at sayitwithsugarGC@gmail.com within 7 days of receiving your order. Once the refund/exchange is approved, we will notify you of a RETURNS AUTHORISATION NUMBER and require it to be posted back to us. Say It With Sugar requires a receipt as Proof of Purchase to be enclosed with the returned goods.
Items must be in unused and unopened condition.
Once we receive your refund/exchange goods, we will assess whether the item is faulty and will contact you directly - in the case that the item is not deemed faulty, we will not be liable for postage costs and we can post the item back to you at your cost. All refund/exchange postage is at the cost of the customer, unless the product is faulty or a mistake has been made by us, we will cover all postage costs.
PLEASE NOTE: Say It With Sugar does not offer refunds/exchanges on perishable/edible items (due to health and safety reasons) OR custom made products. Edible items include any products that can be consumed (food colouring, cake mixes, lustre dusts, edible leaf, chocolate etc.)
Products indicated as no returns - means just that, NO RETURNS. Items listed in the BEST BEFORE, SECONDS and DISCONTINUED sections of our website all fall under this category.
QUALITY OF GOODS
Say It With Sugar provides only high quality products and services. Some of the food items that are listed for sale are perishables - including: cake mixes, sprinkles and other edible items - therefore need to be stored appropriately to ensure the maximum shelf life of the products. Please ensure you have adequate and suitable storage areas before ordering - if you are not familiar with how to store a specific product, please contact us at sayitwithsugarGC@gmail.com. Once delivery has occurred, you are responsible for appropriate storage conditions.
OUT OF STOCK ITEMS
If, for whatever reason we are unable to fulfil your order due to stock unavailability, we will contact you as soon as possible and offer either an alternative product, refund or back order. This is rare, but can happen due to stock being damaged/written off or manual stock level adjustment mistakes.
As per the Say It With Sugar Refunds & Exchanges Policy, we will replace or refund any stock that is deemed faulty by us, following the procedure outlined above upon delivery only. After the 7 day period in which we offer this service, we are not liable for any defects, damaged goods and/or faulty products. You will need to contact the individual manufacturer directly as we are only a reseller/retailer. LOSS OR DAMAGE
You agree to use, browse and purchase from Say It With Sugar's website at your own risk. We will not be held responsible for any loss or damage to your system caused by the use of our website. This includes any links clicked when leaving/entering our website. Say It With Sugar advises that you use appropriate software to protect your own system from malfunction or viruses.
Most of the content on this website, including but not limited to images, information and material in downloadable files is protected by copyright, owned and controlled by Say It With Sugar. Any information and material is solely for your personal use and may not be copied, modified or reproduced in any way, without prior consent from Say It With Sugar.
You agree to indemnify Say It With Sugar from and against any/all claims, expenses, liabilities and action, loss and damage that relates to any transaction or in connection with any content on the website.

Consultations are done predominantly through email/messaging work hours vary day-to-day. Please be patient, as all emails/enquiries will be answered as soon as possible.
QUOTES AND DEPOSITS
Quotes are valid for 10 days from the date of issue. To confirm your booking, a non- refundable 50% deposit is required upon accepting your quote. Please check your personal/order details on your quote before accepting.
For standard orders, full payment is required 3 working days before your pickup date, this will be specified on your invoice.
Work on your order will only commence once the non-refundable 50% deposit has been paid, based on the quote and all designs that have been approved by you. This initial deposit is non-refundable due to some immediate preparation that takes place which needs to be paid for upfront once your order is confirmed (eg. cake toppers, flowers).
By paying your initial deposit, you understand and agree to the following Terms & Conditions.
The balance on your order is due 3 working days prior to your pickup date. A reminder will be sent to you if the balance has not been paid in full. Failure to pay on/before the due date may result in cancellation of your order and loss of your chosen date.
If you choose to cancel your order within 14 days of your pickup date, only your initial non- refundable 50% deposit will be forfeited due to a lot of preparation that takes place which needs to be paid for upfront once your order is confirmed (eg. cake toppers, flowers).
If you cancel your order within 3 days of your pickup date, the FULL AMOUNT will be forfeited.
Once your order has been delivered/picked up, no refunds will be issued.
Minor changes (icing colour, more flowers, extra cupcakes) can be applied to most orders 5-7 days before your event. Major changes (flavours, toppers, different add-ons) require 14-21 days notice. Regardless, you need to advise of ALL CHANGES as soon as possible. A surcharge may be charged for some changes and you will be advised of these costs if applicable.
All cakes, cupcakes and cookies are made and packaged in a safe way so that they are stable when travelling. Once your order has been picked up, it is out of our control what may happen. Say It With Sugar does not accept any responsibility for any accidents that may occur once the order has been collected.
When delivering (multi-tiered cakes), Say It With Sugar is not responsible for and damage to the cake after setup is complete. All of our cakes require a sturdy table and an ideal room temperature of 23°C or below.
It is important to remember that no two cakes are the same. Say It With Sugar strives to provide a finished product that is as close as possible to your requests, however minor flaws and slight colour differences must be allowed for.
Cakes should be refrigerated in their provided box as soon as possible to stop the buttercream from melting. If you are travelling with your cake or displaying it, we do not recommend it being out of the fridge for longer than 2 hours. Once cut - it can be kept in the fridge (in an airtight container) for up to a week, or in the freezer for up to 3 months.
Cookies should be stored in a cool, dry place at room temperature - they will last up to 2 weeks in an airtight container.
Say It With Sugar does not cater for allergy/special dietary requirements. All of our recipes are tried and tested, and cannot be changed. Please be aware that all cakes and cookies are made in a kitchen where allergens such as nuts and gluten are used, and as such we cannot guarantee that any of our products are completely free of all traces of allergens. Say It With Sugar cannot be held liable for any allergic reactions, and the client is responsible for notifying any guests of this.
For wedding cakes – We highly recommend you organise your flowers for the cake through your chosen florist. You can advise us of your chosen florist and we will liaise with them directly to organise a suitable arrangement. This ensures you get the most beautiful finish to your cake to match with your wedding florals.
For all other cakes – we are able to organise flowers through our own supplier unless you would like otherwise.
Please note that for ALL fresh flower displays, they are not food, and therefore may contain pesticides, dirt, insects and other contaminants. Say It With Sugar takes great care when preparing fresh flowers, through washing, sanitising and using barrier methods to reduce these contaminants but these methods are not absolutely guaranteed. Say It With Sugar cannot be held responsible for any reactions caused by potential hazards.
All products will be photographed by us. Say It With Sugar reserves the right to use any photographs for display or promotion without compensation to the client. These photographs may be displayed on our website or other advertising materials.
Performance of this agreement is contingent upon the ability of Say It With Sugar to complete the agreement and is subject to accidents, Acts of God and other causes beyond our control. In the rare instance where Say It With Sugar is unable to complete your agreed upon order, all efforts will be made to find a suitable baker/decorator. Should another baker/decorator not be available, a full refund will be issued on any payments made.
